This Release and Waiver of Liability (the "Release") executed on
09/04/2010.
(the “Volunteer”), and (in the case of a minor child), the parent having legal custody and/or legal guardian of the volunteer (“the
Guardian”), in favor of Hilltop Rescue & Relief, a ministry of the Hilltop Community Church of Christ, a California nonprofit
organization, their directors, officers, employees, and agents (collective, “Hilltop”)
The Volunteer (and Guardian) desires that the Volunteer works as a volunteer for Hilltop and engage in the activities related to being
a volunteer (the aˆ?Activities). The Volunteer (and Guardian) understands that the Activities may include constructing and rehabilitating
residential and/or commercial buildings, working in the Hilltop office, working in the Hilltop Warehouse, and living in housing
provided for volunteers of Hilltop. The Volunteer (and Guardian) hereby freely, voluntarily, and without duress executes this Release
under the following terms:
1. Release, Waiver and Discharge. Covenant not to sue. The Volunteer (and Guardian) does hereby release and forever discharge and hold harmless
Hilltop and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or
may hereafter arise from Volunteeraˆ™s Activities with Hilltop. The Volunteer (and Guardian) understands that this Release discharges Hilltop from any
liability or claim that the Volunteer may have against Hilltop with respect to any bodily injury, personal injury, illness, death, or property damages that
may result from Volunteeraˆ™s work for Hilltop, whether caused by the negligence of Hilltop or its officers, directors, employees, or agents or otherwise. The
Volunteer understands that this Release and Waiver of Liability shall bind the members of my family including my spouse, and my heirs, assigns and/or
personal representative. The Volunteer (and Guardian) also understands that, except as otherwise agreed to by Hilltop in writing, Hilltop does not assume
any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in
the event of injury or illness.
2. Medical Treatment. Except as otherwise agreed to by Hilltop in writing, the Volunteer (and Guardian) does hereby release and forever discharge Hilltop
from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteeraˆ™s
Activities with Hilltop or (in case of a minor child) with the decision by any representative or agent of Hilltop to exercise the power to consent to
medical or dental treatment as such power may be granted and authorized in the Parental Authorization for Treatment of a Minor Child.
3. Assumption of the Risk. The Volunteer (and Guardian) understands that the Activities included work that may be hazardous to the Volunteer, including,
but not limited to, construction, loading and unloading, and transportation to and from work sites. Volunteer (and Guardian) hereby expressly and specifically
assumes the risk of harm in the activities and releases Hilltop from all liability for injury, illness, death, or property damage resulting from the Activities.
4. Insurance. The Volunteer (and Guardian) understands that, except as otherwise agreed to by Hilltop in writing, Hilltop does not carry or maintain health,
medical, or disability insurance for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health and auto
insurance coverage.
5. Media Release. The Volunteer (and Guardian) does hereby grant and convey unto Hilltop all right, title, and interest in any and all photographic images or
video or audio recordings made by Hilltop during Volunteeraˆ™s Activities with Hilltop, including, but not limited to, any royalties, proceeds, or other benefits
derived from such photographs or recordings. The Volunteer gives permission to Hilltop to use his/her likeness in photographs, video and/or audio
recordings.
6. Other. The Volunteer (and Guardian) expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of
California, and that this Release shall be governed by and interpreted in accordance with the laws of the State of California. The Volunteer agrees that in
the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or
provision shall not otherwise affect the remaining provisions of the Release which shall continue to be enforceable.
I HEREBY CERTIFY THAT THE INFORMATION HERE IS ACCURATE AND HEREBY EXECUTE
THIS RELEASE.
